To secure and maintain your reservation for the February 5–8, 2027 retreat weekend, all payment plan installments must be made by their scheduled due dates.

If a payment is not received by the applicable due date, attendees may be granted a brief grace period at the sole discretion of the event organizers. Failure to submit payment within the grace period may result in:

  • Suspension of the attendee’s payment plan
  • Cancellation of the reservation and forfeiture of the reserved spot
  • Loss of any promotional pricing or payment plan privileges
  • Application of the event cancellation policy to all amounts previously paid

If a reservation is canceled due to missed or incomplete payments, previously paid amounts will be refunded only in accordance with the stated cancellation and refund schedule. After November 1, 2026, no refunds will be issued for canceled reservations, including cancellations resulting from missed payments.

If an attendee anticipates difficulty making a scheduled payment, they are encouraged to contact the event organizers as early as possible to discuss potential accommodations.

Cancellation Policy

Due to the planning, coordination, and limited-capacity nature of the February 5–8, 2027, event weekend, all cancellation requests must be submitted in writing to the event organizers. Refund eligibility is based on the date the cancellation request is received.

Refund Schedule:

  • Cancellations made on or before August 31, 2026, are eligible for a full refund of payments made.
  • Cancellations made between September 1, 2026, and September 30, 2026, are eligible for a 50% refund of payments made.
  • Cancellations made between October 1, 2026, and October 31, 2026, are eligible for a 25% refund of payments made.
  • Beginning November 1, 2026, no refunds will be issued for cancellations made on or after this date, including no-shows or unused portions of the event.

All approved refunds will be processed to the original payment method within a reasonable processing timeframe.  Event tickets may not be transferred to another guest without prior written approval from the event organizers.

Event Participation Agreement & Liability Waiver

By registering for and attending THE GATHERING with DAMIAN McGINTY (“the Event”), hosted by Damian McGinty and DMcG International Productions, LLC (“Organizers”), you agree to the following terms and conditions. Please read this Agreement carefully before registering. It affects your legal rights.

1. Participation & Voluntary Assumption of Risk

I understand that participation in the Event involves inherent risks associated with travel, lodging, group activities, winter weather conditions, outdoor walkways and stairs, transportation, food service, and recreational activities, including but not limited to risks associated with snow, ice, slippery walkways, uneven terrain, stairs, fireplaces, outdoor paths, rural roads, and changing winter weather conditions. I voluntarily and knowingly assume all risks associated with my participation, including but not limited to personal injury, illness, emotional distress, property damage, delayed travel, weather-related disruptions, or other unforeseen circumstances. Organizers are not responsible for lost, stolen, or damaged personal property.

I acknowledge that participation in all Event activities is entirely voluntary and that I am free to decline any activity at any time. I agree to comply with reasonable safety instructions, emergency procedures, evacuation requests, and venue rules communicated by Organizers, Event staff, or venue personnel.

2. Health & Personal Responsibility

I certify that I am physically and mentally able to participate in the Event and its activities. I understand that Organizers are not medical professionals and are not responsible for providing medical care, medications, or health services.

I understand that participation in group events may involve exposure to communicable illnesses, including but not limited to COVID-19, influenza, or other contagious conditions, and I voluntarily assume such risks.

I agree to take full responsibility for:

  • my own health and wellbeing throughout the Event;
  • any required medications or medical equipment;
  • dietary needs or allergies disclosed during registration;
  • my personal belongings at all times; and
  • notifying Organizers of any material changes to my health status that occur between registration and the Event.

I further consent to Organizers contacting emergency medical services on my behalf if, in their reasonable judgment, I appear to require immediate medical assistance. Such contact shall not constitute a waiver of this Agreement or create any medical liability on the part of Organizers.

3. Release of Liability & Indemnification

3a. Release of Liability

To the fullest extent permitted by law, I release and hold harmless Damian McGinty, DMcG International Productions, LLC, Event staff and volunteers, venue owners and employees, contractors, performers, and all affiliated parties (collectively, “Released Parties”) from any and all claims, liabilities, damages, losses, injuries, expenses, or causes of action—whether known or unknown—arising out of or related to my participation in the Event, including travel to and from the event.

This release includes claims arising from the ordinary negligence of the Released Parties but does not apply to gross negligence or intentional misconduct.

3b. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) my breach of this Agreement; (b) my negligent or wrongful conduct during the Event; or (c) any third-party claims arising from my actions or omissions in connection with the Event.

4. Travel & Weather

I understand that the Event takes place during winter in the Catskills region and that weather-related disruptions may occur, including travel delays, hazardous road conditions, or schedule adjustments. I acknowledge that:

  • Organizers are not responsible for operating, supervising, or in any way managing transportation arranged independently by participants, including but not limited to carpools, rideshares, or rides coordinated among attendees;
  • all travel arrangements to and from the Event are solely my responsibility;
  • missed flights, transportation delays, or personal scheduling conflicts do not qualify for refunds;
  • the Event may proceed as scheduled despite inclement weather unless Organizers determine otherwise for safety reasons;
  • outdoor activities, excursions, and scheduled programming may be modified, delayed, relocated, or cancelled due to weather, venue conditions, safety concerns, or other operational considerations at Organizer discretion; and
  • I am strongly encouraged to purchase comprehensive travel insurance prior to the Event.

5. Cancellation & Refund Policy

By registering, I acknowledge and agree to the cancellation and refund policy published on the Event website, which is incorporated into this Agreement by reference. In the event of a conflict between this Agreement and the published policy, the published policy shall control with respect to refund terms.

I understand that:

  • deposits may be non-refundable;
  • refund amounts may decrease as the event date approaches; and
  • refunds may not be available within the final cancellation window.

6. Code of Conduct

The Event is intended to foster a warm, respectful, and inclusive environment for all attendees, staff, artists, and venue personnel. I agree to treat all persons with dignity and respect throughout the Event.

The following behaviors may result in immediate removal from the Event without refund, at the sole discretion of Organizers:

  • harassment, intimidation, or discrimination of any kind;
  • unwanted physical contact;
  • excessive intoxication or disruptive behavior;
  • threats or acts of violence; or
  • any violation of venue policies or applicable law.

Organizers reserve the right, in their sole discretion, to determine whether conduct violates this Code of Conduct.

Organizers are facilitating a social and recreational experience, not acting as caregivers, counselors, therapists, security providers, or personal supervisors. Each participant is responsible for their own decisions, conduct, wellbeing, and personal safety throughout the Event.

Where a minor participant is attending the Event, the accompanying parent or legal guardian is solely responsible for the minor’s supervision, conduct, and wellbeing at all times during the Event. Organizers assume no supervisory or caregiving responsibility for minor participants.

7. Photography & Media

Photography and video recording may occur during the Event for promotional and archival purposes by Organizers. By attending, I grant Organizers a perpetual, royalty-free license to use my likeness in event-related photography, video, and promotional materials.

If I wish to opt out of this grant, I must notify Organizers in writing no later than fourteen (14) days prior to the first day of the Event. Opt-out requests submitted after this deadline may not be honored.

Organizers will make reasonable efforts to honor approved opt-out requests but cannot guarantee that participants will not appear incidentally in crowd or background footage.

Where a participant is a minor, the parent or legal guardian signing this Agreement on the minor’s behalf hereby grants (or withholds, as indicated below) consent for the minor’s likeness to be used by Organizers for event-related photography, video, and promotional materials. To withhold consent for a minor’s likeness, the parent or legal guardian must notify Organizers in writing no later than fourteen (14) days prior to the first day of the Event.

Note: This section governs Organizer-produced content. Participants are individually responsible for obtaining consent before photographing or recording other attendees.

8. Rooming & Shared Accommodations

Participants are responsible for their conduct in shared spaces and agree to respect the privacy and comfort of fellow guests. Organizers are not responsible for lost, stolen, or damaged property within shared accommodations or common areas.

9. Property Damage

Participants are financially responsible for any damage they cause to venue property, furnishings, equipment, or common areas during the Event. Organizers reserve the right to charge the payment method on file for reasonable repair or replacement costs arising from damage attributable to a participant’s actions or negligence.

10. Accessibility & Special Accommodations

Organizers will make reasonable efforts to accommodate disclosed accessibility needs and dietary restrictions. However, accommodations are limited by what the venue is able to provide. Organizers cannot guarantee accommodations beyond the physical capabilities of the venue.

Participants are strongly encouraged to communicate accommodation requests as early as possible and no later than the deadline specified during registration.

11. Animals

For the comfort and safety of all guests, animals are not permitted at the Event or on venue property, with the sole exception of service animals as defined under the Americans with Disabilities Act.

Emotional support animals, therapy animals, and pets are not permitted at the Event.

Participants planning to bring a service animal must notify Organizers in writing prior to the Event. Organizers reserve the right to ask whether an animal is a service animal required due to a disability and what work or task the animal has been trained to perform, consistent with applicable law.

12. Alcohol Responsibility

Alcohol may be available during portions of the Event. Participants who choose to consume alcohol agree to do so responsibly and in accordance with all applicable laws and venue policies. Participants must be of legal drinking age in the State of New York (21 years of age) to consume alcoholic beverages.

Organizers reserve the right to restrict or prohibit alcohol consumption by any participant at any time. Excessive intoxication, unsafe behavior, harassment, or violation of venue policies may result in immediate removal from the Event without refund.

I acknowledge full personal responsibility for my decisions and conduct related to alcohol consumption and release all Released Parties from any liability arising from alcohol-related incidents, injuries, damages, or misconduct attributable to my own actions.

Where a minor is attending the Event, the parent or legal guardian accompanying the minor is solely responsible for ensuring that the minor does not consume alcohol or any other age-restricted substances at any time during the Event.

13. Right to Refuse or Revoke Attendance

Organizers reserve the right to refuse registration or revoke attendance at any time prior to or during the Event, at their sole discretion.

Participants whose registration is refused or revoked prior to the start of the Event will receive a full refund of amounts paid. Participants removed during the Event due to violations of the Code of Conduct or other conduct deemed disruptive or unsafe by Organizers will not be eligible for a refund.

14. Artist Interaction & Programming Expectations

Event programming is designed to foster a warm and intimate group experience; however, Organizers do not guarantee any specific level of personal interaction, one-on-one access, performance duration, or individualized attention from any artist, performer, or guest participant.

Programming, appearances, schedules, and activities are subject to change at Organizer discretion.

Organizers reserve the right to make reasonable substitutions, modifications, or schedule changes to Event programming, accommodations, presenters, activities, or amenities when necessary.

15. Minor Participants

Participants under the age of eighteen (18) (“Minor Participants”) are permitted to attend the Event only when accompanied at all times by a parent or legal guardian who is also registered for and attending the Event (“Accompanying Guardian”).

Because minors generally lack legal capacity to enter into binding contracts, this Agreement must be signed by the Accompanying Guardian on behalf of the Minor Participant. By signing below, the Accompanying Guardian represents and warrants that they are the parent or legal guardian of the Minor Participant and have full authority to execute this Agreement on the minor’s behalf.

The Accompanying Guardian agrees to:

  • supervise the Minor Participant at all times during the Event and take full responsibility for the minor’s safety, conduct, and wellbeing;
  • ensure the Minor Participant does not consume alcohol or any other age-restricted substances;
  • ensure the Minor Participant complies with all Event rules, venue policies, and the Code of Conduct set forth in Section 6; and
  • provide current emergency contact information for the Minor Participant during registration.

The Accompanying Guardian further acknowledges and agrees, on behalf of the Minor Participant, to all terms of this Agreement, including the Release of Liability and Indemnification provisions set forth in Section 3. The Accompanying Guardian agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or losses arising from or related to the Minor Participant’s attendance at or participation in the Event.

16. Force Majeure

Organizers shall not be liable for any delay, modification, interruption, or cancellation of the Event resulting from causes beyond their reasonable control, including but not limited to: severe weather, natural disasters, fire, flood, public health emergencies, epidemics or pandemics, government actions or restrictions, labor disputes, utility failures, transportation disruptions, venue unavailability, or illness or emergency affecting performers or key staff.

In the event of such circumstances, Organizers reserve the right to modify the schedule or programming, substitute activities or venues, postpone, or cancel the Event. Organizers will make reasonable efforts to communicate changes promptly and to provide appropriate credits, transfers, or partial refunds where feasible; however, full refunds are not guaranteed in all force majeure situations.

In the event of postponement, registered participants will receive a credit toward the rescheduled dates equal to the amount paid. Participants unable to attend the rescheduled dates may request a refund within thirty (30) days of the postponement announcement; refund amounts will be determined in accordance with the then-applicable cancellation policy. Organizers are not responsible for any travel, lodging, or other costs incurred by participants in connection with a postponed or cancelled Event.

In addition to the circumstances described above, Organizers reserve the right to cancel, postpone, or materially modify the Event at any time for any operational, logistical, safety, or business reason, including but not limited to circumstances where, in Organizers' sole judgment, participation levels or other factors make it impracticable to deliver the Event experience as intended. In the event of an Organizer-initiated cancellation under this provision, registered participants will receive a full refund of amounts paid. Organizers are not responsible for any travel, lodging, or other costs incurred by participants in connection with such a cancellation. Participants are strongly encouraged to purchase travel insurance.

17. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Any dispute arising out of or relating to this Agreement or the Event that cannot be resolved informally shall be submitted to binding arbitration administered by JAMS (or a mutually agreed-upon arbitration service) in accordance with its applicable rules. Arbitration shall take place in Tennessee, and the arbitrator’s decision shall be final and binding.

The parties expressly waive any right to a trial by jury in any action or proceeding arising out of or relating to this Agreement or the Event.

Any arbitration or legal proceeding shall be conducted solely on an individual basis and not as part of any class, collective, consolidated, or representative action.

The prevailing party in any arbitration or legal proceeding arising out of or relating to this Agreement shall be entitled to recover its reasonable attorneys’ fees and costs.

Nothing in this section prevents either party from seeking temporary, emergency, injunctive, or equitable relief in a court of competent jurisdiction.

18. Severability

If any provision of this Agreement is found to be invalid, unenforceable, or contrary to law, that provision shall be deemed severed from the Agreement, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

This Agreement, together with any policies incorporated by reference (including the Cancellation & Refund Policy published on the Event website), constitutes the entire agreement between the parties with respect to participation in the Event and supersedes any prior representations, promises, or understandings, whether oral or written.

20. Acknowledgment & Agreement

I agree that electronic acceptance of this Agreement, including checking an acknowledgment box or submitting an online registration form, constitutes my electronic signature and indicates my intent to be legally bound by these terms.

By registering for the Event, I acknowledge that:

  • I have read and fully understand this Agreement;
  • I voluntarily agree to all terms and conditions set forth herein;
  • I understand that this Agreement affects my legal rights, including my right to bring certain legal claims; and
  • I am signing this Agreement freely and without coercion.

 

For Minor Participants Only — Parent or Legal Guardian Signature

I am the parent or legal guardian of the Minor Participant named above. I have read this Agreement in full, I understand its terms, and by registering the Minor Participant I acknowledge that I understand and agree to all provisions on behalf of the Minor Participant, including but not limited to the Release of Liability and Indemnification provisions in Section 3 and all obligations set forth in Section 15.
